1. Who is responsible

BIONIC, 8 Bis Rue Abel, 75012 Paris, France, is the controller of personal information it processes in operating bionicparis.com, fulfilling orders and dealing with customers. Contact us at hello@bioniclabs.org or +49 170 1286533. Shopify hosts the store and may also process information for its own services as explained below.

2. Information we process and where it comes from

Depending on how you use the store, we process your name, email address, telephone number, billing and delivery addresses, order and payment transaction details, returns and support history, account details, communications with us, and information about products you view or place in a cart. The store and its providers also process technical information such as IP address, device and browser information, cookie identifiers and use of the website. Payment providers handle payment credentials; BIONIC receives the information needed to confirm and administer payment and is not asking you to send full payment-card details by email.

We obtain information directly from you, automatically when you use the site, and from providers involved in payments, fraud screening, delivery, customer support and the Shopify platform. If you do not provide information needed to take payment, deliver an order or respond to a claim, we may be unable to provide that service. Providing information for optional marketing is not required to buy from us.

3. Why we use information and our legal bases

We use order, contact and payment transaction information to process purchases, deliver goods, provide order updates and handle returns or support. For customers in the EU or EEA, the main legal basis is performance of our contract or steps requested before a contract.

We use records needed for invoices, tax, accounting and responses to lawful requests to meet legal obligations. We use information needed to secure the store, prevent and investigate fraud, manage disputes and improve our services on the basis of our legitimate interests, where those interests are not overridden by your rights.

We use contact information for newsletters or other promotional messages where you have consented or where another lawful marketing basis applies. You can unsubscribe from marketing messages at any time using the link in the message or by contacting us. We use optional cookies and similar technologies for analytics, personalisation or advertising only when and to the extent permitted by your choices and applicable law.

4. Shopify and other recipients

We share information as needed with Shopify, payment and fraud-prevention providers, delivery and fulfilment partners, customer-service and technology providers, professional advisers, and public authorities where required by law. We share only information relevant to the task. These parties may process information on our behalf or, for particular services, as independent controllers under their own notices.

Shopify processes information about visits and purchases to provide the store and its services. We use Shopify enhanced features through which Shopify may use information from interactions with BIONIC, other merchants and Shopify for fraud prevention, service improvement and personalised advertising. Shopify explains its own processing and the rights available to you in the Shopify Consumer Privacy Policy at https://www.shopify.com/legal/privacy/consumers and its privacy portal at https://privacy.shopify.com/en/. You can also contact us at hello@bioniclabs.org to request an opt-out of advertising-related sharing where that right applies.

Disclosures for personalised advertising may be treated as a “sale” or “sharing” under some privacy laws. Where those laws apply, you may ask us to opt you out by emailing hello@bioniclabs.org. We will honour valid requests and any applicable browser-based opt-out preference. We may also disclose relevant information to protect our rights, investigate fraud, comply with law, or in connection with a genuine business transfer.

5. Cookies and similar technologies

The store uses technologies necessary to run checkout, maintain a cart, remember essential preferences and keep the site secure. The store also presents choices about optional cookies and similar technologies for analytics and advertising. Where consent is required, we use those technologies only with your consent. You may accept or decline optional cookies through the cookie banner. To change or withdraw a previous choice, use the store's privacy or cookie controls or contact hello@bioniclabs.org.

6. International processing

Shopify and other providers may process information outside France, the EU or your country. Where EU or UK transfer law requires a safeguard, we rely on an applicable adequacy decision or another lawful transfer mechanism, such as approved standard contractual clauses, as appropriate to the transfer. You may contact us for further information about the safeguards relevant to your information.

7. Retention and security

We keep information only as long as needed for the purpose for which it was collected and any applicable legal obligation or claim. Order and invoice records are retained for the applicable French accounting and tax periods. Support and dispute records are retained while an issue is open and for the period needed to establish, exercise or defend legal claims. Marketing information is kept until consent is withdrawn or it is no longer needed under applicable retention rules. Technical and security information is kept for a period appropriate to its purpose. We delete, anonymise or restrict access when the relevant period ends.

We use proportionate security measures and limit access to people and providers who need the information. No internet transmission or storage system is completely risk-free. Please do not send full payment-card numbers or other unnecessary sensitive information by email.

8. Your rights and choices

Depending on the law that applies to you, you may request access to or a copy of your information; correction or deletion; restriction of or objection to processing; portability; and withdrawal of consent. Withdrawal of consent does not affect earlier lawful processing. You may also have rights to opt out of targeted advertising or certain data sharing. Send requests to hello@bioniclabs.org. We may ask for information reasonably needed to verify your identity and will respond within the period required by law. We do not penalise customers for exercising privacy rights.

For Shopify's own processing, you may also use https://privacy.shopify.com/en/. EU residents may complain to their local supervisory authority or to France's CNIL at https://www.cnil.fr/. UK residents may contact the UK Information Commissioner's Office. You may contact us first so we can address a concern directly.

9. Children, third-party sites and changes

The store is not directed to children, and we do not knowingly seek their personal information. Links to third-party sites are governed by those sites' own policies. We may update this policy to reflect changes in our practices or legal duties; the current version and its update date will be published here, and we will give any further notice required by law.
