Terms of sale
1. Seller and scope
These terms apply to goods sold through bionicparis.com by BIONIC, a French société par actions simplifiée (SAS), registered with the Paris Trade and Companies Register under SIREN 945 007 797, at 8 Bis Rue Abel, 75012 Paris, France; hello@bioniclabs.org; +49 170 1286533. The product description, price, delivery information and any specific conditions presented before checkout form part of the order. The Return and refund policy and Shipping policy explain the corresponding procedures and rights. These terms do not remove rights that applicable consumer law makes mandatory.
2. Products and information before purchase
Product pages describe the main characteristics, available configurations and any accessories included. Please check dimensions, finishes, compatibility and the order summary before paying. Illustrations may vary with lighting, screens and shown accessories; this does not excuse a product that fails to conform to its description or any other statutory requirement. We will identify a genuine personalised or custom-specification product, and any claimed withdrawal exception, clearly before purchase. A “made to order” label or a choice among standard options does not alone make an item legally bespoke.
3. Orders and contract formation
To order, select the product and configuration, review the cart, provide delivery and payment details, review the total price and relevant terms, then submit the order using the checkout button that states the payment obligation. You can correct entries before submission. An automatic acknowledgement confirms that we received the order; it does not necessarily mean that we accepted it. The contract is formed when we send an order acceptance or dispatch confirmation, or otherwise clearly accept the order. We will provide the contract information and order confirmation by email or another durable medium. Please retain that confirmation. If we cannot accept an order, we will notify you and refund any payment taken without undue delay.
We may decline an order before acceptance for a genuine stock, payment, fraud-prevention or delivery issue. If a material pricing or product-description error is discovered after an order is placed, we will explain it and request your agreement to any correction; we will not impose a higher price or different product without consent. If no lawful agreement is reached, the order will be cancelled and any payment returned. This does not limit remedies where a binding contract has already been formed.
4. Prices, payment and taxes
The price and currency shown at checkout apply to the order. EU consumer prices include applicable VAT unless checkout clearly states a lawful exception. Delivery charges and any other charges collected by BIONIC are itemised before submission. For non-EU destinations, local import duties, taxes or customs charges may be payable by the recipient when clearly disclosed before purchase; the Shipping policy gives further details. Your payment method will be charged as explained at checkout. We may use payment providers to authorise payment and conduct proportionate fraud screening. A payment dispute does not by itself remove a customer’s legal remedies.
5. Delivery, ownership and risk
The delivery destination, service, charge and relevant dispatch or delivery period are those shown in the order information. The Shipping policy explains delays, failed delivery and international customs. Unless applicable law provides otherwise, the risk of loss or damage passes to a consumer when the consumer, or a person designated by the consumer other than our carrier, physically receives the goods. Ownership transfers once the price has been paid and delivery has occurred, to the extent permitted by applicable law. Any statutory remedy for non-delivery or material delay remains available, including a refund to the original payment method when required by law.
6. Change-of-mind cancellation and returns
For eligible EU consumer orders, the statutory withdrawal period is 14 days after receipt, subject only to applicable legal exceptions. A valid EU withdrawal is refunded to the original payment method under the conditions in the Return and refund policy. We do not charge an EU statutory-withdrawal restocking fee. UK and other mandatory local cancellation rights also remain available.
Outside mandatory cancellation regimes, eligible standard goods delivered outside the EU, EEA and UK may be voluntarily returned on the conditions in the Return and refund policy: contact us within 14 days after delivery, pay return shipping and any applicable return customs charges, and receive store credit for the product price less a 20% restocking fee after inspection. Products clearly marked final sale before purchase, including clearance items, are excluded from this change-of-mind offer. This voluntary offer does not replace a mandatory refund or defect remedy. For change of mind outside a mandatory cancellation right, the Monitor Stand, Editor Desk and any other clearly identified made-to-order or personalised goods are final sale and cannot be cancelled after acceptance, including before delivery. This does not limit non-delivery, delay, defect or other rights provided by law.
7. Legal guarantee of conformity for French consumers
The following summary concerns the French statutory legal guarantee of conformity for consumers. It applies independently of any commercial warranty and covers goods, including goods sold as final sale or made to order. A consumer may invoke it for a lack of conformity that appears within two years after delivery. During that period, the consumer generally needs to show that the lack of conformity exists, rather than establish the date on which it arose; the statutory presumption about the defect’s existence at delivery applies under the conditions set by law.
The consumer may request repair or replacement. We may refuse the chosen option only where the law permits, including impossibility or disproportionate cost. The remedy must be provided without charge, including necessary transport, removal and installation costs where applicable, within 30 days of the request and without major inconvenience to the consumer. Repair extends the legal guarantee by six months. If we impose replacement instead of a repair requested by the consumer, a new two-year guarantee period starts on delivery of the replacement.
The consumer may obtain a price reduction or terminate the contract and receive a refund where the statutory conditions are met: for example, if we refuse the remedy, fail to complete it within 30 days or without major inconvenience, or the non-conformity persists. Where the defect is sufficiently serious, the consumer need not first request repair or replacement. Termination is unavailable for a minor lack of conformity where the law so provides. The guarantee period is suspended while a repair or replacement is pending as provided by law. The consumer is not charged for exercising these rights. We will reimburse the reasonable return or collection costs for a valid guarantee claim as required by law.
French consumers also have the separate legal guarantee against hidden defects under the French Civil Code. An action under that guarantee may generally be brought within two years of discovering the defect, subject to the applicable conditions, and may allow return of the goods for a refund or retention of the goods with a price reduction. These statutory rights are not limited by this summary. Consumers in other countries retain any mandatory conformity, warranty or consumer-guarantee rights that apply to them.
8. Optional commercial warranty and support
Any optional commercial warranty applies only if its duration, scope, guarantor, territorial coverage and claim procedure are provided separately with the product. It is additional to statutory rights. Unless a specific commercial warranty is clearly offered, these terms do not create one. For a defect, damaged item, incorrect item or missing delivery, contact hello@bioniclabs.org with the order number and relevant details. Photographs can help us investigate but are not a universal condition of a valid statutory claim.
9. Complaints and disputes
Please send complaints to hello@bioniclabs.org or BIONIC, 8 Bis Rue Abel, 75012 Paris, France. We will review them and respond within a reasonable time.
French law governs the contract, without depriving a consumer of mandatory protections applicable in the consumer’s country of habitual residence. Courts have jurisdiction under applicable law, including rules protecting consumers. Nothing here requires pre-dispute arbitration or makes a chargeback, lawful complaint or statutory claim a forfeiture of rights. We may contest an unsupported payment dispute using accurate order and delivery records and may prevent duplicate recovery of the same amount.
10. Changes and contact
The terms applicable to an order are those provided at the time the contract was made, together with any later change that the customer validly accepts. We may update these terms for future orders by publishing a revised version. Questions about an order or these terms can be sent to hello@bioniclabs.org or raised by telephone at +49 170 1286533.
