Terms of service
1. Operator and scope
bionicparis.com is operated by BIONIC, 8 Bis Rue Abel, 75012 Paris, France. These terms govern use of the website. Purchases are also governed by our Terms of sale, Return and refund policy, and Shipping policy. Our store is hosted by Shopify, which processes information about visits and purchases to provide its services and may use information from interactions with BIONIC, other merchants and Shopify for enhanced services. Information may be shared with Shopify and service providers in other countries. Our Privacy policy explains this processing and how to exercise privacy rights. If a provision conflicts with a non-excludable consumer right, that right applies.
2. Using the website
You may use the website for lawful personal or business purposes. You must not interfere with its security or operation, attempt unauthorised access, introduce harmful code, submit false information, or use the site to infringe another person's rights. You are responsible for ensuring that information you provide for an order or account is accurate and current. If you create an account, keep its credentials secure and tell us promptly if you suspect unauthorised use.
We may restrict access where reasonably necessary to protect the website, customers, BIONIC or other users, or to comply with law. Restricting site access does not remove rights relating to an existing order. Contact hello@bioniclabs.org if you need assistance with an existing purchase.
3. Product information and availability
We aim to describe products, prices, dimensions, materials, finishes, compatibility and availability accurately. Product details, dispatch estimates and any specific conditions shown on a product page or at checkout form part of the information on which the purchase is made. Images may show products in different settings or with accessories that are not included; the product description and order summary identify what is supplied. If we discover a material error affecting an order, we will contact you and offer an appropriate correction or cancellation and refund, subject to applicable law. We do not reserve a right to alter an accepted consumer order unilaterally.
4. Intellectual property and third-party marks
The text, photographs, product designs, graphics and other site material belong to BIONIC or its licensors unless stated otherwise. You may view the site and keep copies needed for personal reference or a purchase. Reproduction, commercial use or redistribution requires permission unless law allows it. Names and marks of third parties remain their owners' property. Descriptive references to third-party products do not create a warranty for those products or imply an affiliation.
5. Links, reviews and submissions
The site may link to third-party sites or services. Their terms and privacy practices apply when you use them. If you submit a review, question or other content to BIONIC for publication, you confirm that you have the right to submit it and that it is lawful and accurate to the best of your knowledge. You permit us to display it for the purpose for which it was submitted, subject to your rights and applicable law. We may remove unlawful or misleading material.
6. Changes and availability
We may change site features or these website-use terms. Changes will be posted with an updated date and will apply prospectively, except where law permits otherwise. The terms and policies applicable to a purchase are those presented when the order was placed, together with any later change that the customer validly accepts. We may perform maintenance or respond to events affecting site availability, but this does not remove our obligations for paid orders.
7. Liability and legal rights
Nothing in these terms excludes liability or remedies that cannot lawfully be excluded, including statutory consumer guarantees, liability for fraud or intentional misconduct, or liability for death or personal injury where exclusion is prohibited. Subject to those rights, BIONIC is not responsible for losses caused solely by a customer's unlawful use of the website or by an independent third-party service outside our control. Any further limitation applies only to the extent permitted by the law governing the particular claim.
8. Questions and disputes
Please contact hello@bioniclabs.org if you have a problem so we can investigate and propose a solution. Contacting us first is encouraged, but it is not a condition for exercising a statutory right or raising a lawful payment dispute. We may provide accurate transaction and delivery records to a payment provider or competent authority when responding to a dispute. We do not treat the mere act of filing a chargeback as forfeiture of a refund or guarantee claim.
French law governs these terms, without depriving consumers of mandatory protections that apply in their place of habitual residence. Courts have jurisdiction as provided by applicable law. No pre-dispute arbitration obligation is imposed by these terms.
